After the receipt of that letter, Sir A.V.

de Sausmarez raised objections to the provisions of the

Order in Council as then drafted, and in order to meet

his objections the provisions were recast in the form

in which they now appear as Articles 2 and 3 of the China

and Corea (Amendment) Order in Council 1910. Article 3

provides for the possibility of the Governor of Hong

Kong being empowered, by Hong Kong legislation, to carry

out the deportation of the prisoner in such cases.

It would appear from Sir H.W. de Sausmarez'

despatch that no such legislation has been passed, and

that the Colonial Authorities are unaole in the case of

a prisoner who has been sent for imprisonment to Hong

Kong, and in whose case an order for deportation has

been made, to deport him, and can only cause him to

be returned to Shanghai.

In view of the unsatisfactory situation which

thus arises, Sir E. Grey would be glad to learn whether,

in the opinion of Mr. Harcourt, it would now be possible
